1. Agreement
These terms govern your use of gystiq.com (the “Site”), operated by GYSTiq, LLC, a Wisconsin limited liability company (“GYSTiq”, “we”, “us”). By using the Site you agree to them. If you do not agree, please do not use the Site.
If you engage GYSTiq to provide services, those services are governed by a separate written agreement between us. Where that agreement and these terms conflict, that agreement controls.
2. Who may use the Site
The Site is intended for business use by people who are at least 18 years old and able to enter a binding contract. It is not directed to children.
3. Using the Site
You may view the Site and contact us through it for legitimate business purposes. You agree not to:
- use the Site unlawfully, or to break any applicable law or regulation
- attempt to gain unauthorised access to the Site, its servers, or any connected system, or probe or test its security
- interfere with the Site’s operation, including by introducing malicious code or by placing unreasonable load on it
- scrape, harvest or systematically extract content or contact details from the Site
- misrepresent who you are or who you act for
We may suspend or withdraw access to the Site at any time, including to anyone we reasonably believe is breaching these terms.
4. What you send us
When you submit the contact form or otherwise send us information, you confirm the information is accurate and that you are entitled to provide it. Please do not send us confidential information, personal information about other people, or anything you would not want us to hold, until we have a written agreement in place that covers it.
We handle information you send us as described in our Privacy Policy.
5. Our content
The Site and its content, including text, graphics, the GYSTiq name and logo, and its layout and design, belong to GYSTiq or its licensors and are protected by intellectual property law. You may view and print pages for your own business evaluation. You may not otherwise copy, republish, modify, or use our content or branding without our written permission.
6. Information on the Site is general
The Site describes our services and our approach. It is general information, not professional, financial, legal or technical advice, and it is not an offer capable of acceptance. Nothing on the Site creates a client relationship. Any figures, benchmarks or examples are illustrative and are not a promise of any particular outcome.
7. Third-party links and services
The Site links to third-party websites and loads some content from third-party providers. We do not control those parties and we are not responsible for their content, their availability, or their handling of your information. Links are not an endorsement.
8. Availability
We aim to keep the Site available but we do not promise it will be uninterrupted or error free. We may change, suspend or withdraw all or part of it without notice, and we are not liable if the Site is unavailable.
9. Disclaimer
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, and we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the content is accurate, complete, current, or free of viruses or other harmful components.
10. Limitation of liability
To the fullest extent permitted by law, GYSTiq and its members, managers, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill or business interruption, arising out of or relating to your use of the Site, however caused and on any theory of liability.
Our total liability arising out of or relating to the Site will not exceed one hundred United States dollars (US$100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to the extent permitted, and nothing in these terms limits liability that cannot lawfully be limited.
This section does not limit or vary liability under any separate services agreement between us, which sets its own terms.
11. Indemnity
You agree to indemnify and hold harmless GYSTiq and the people listed in section 10 from any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your use of the Site in breach of these terms or of applicable law.
12. Governing law and venue
These terms are governed by the laws of the State of Wisconsin, without giving effect to its conflicts of laws principles. You and we agree that the state and federal courts located in Wisconsin have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Site, and you consent to their jurisdiction and venue.
13. Changes
We may update these terms. The current version is always posted here with the date at the top. Continuing to use the Site after a change means you accept the updated terms.
14. General
If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.
